Cyberbullying and Internet Harassment

Social networking websites, such as Facebook, have become a nearly inextricable part of daily life in the United States. In light of the growing concerns surrounding cyberstalking, cyberbullying, and other forms of Internet harassment, the state of Texas passed the Stalking by Electronic Communications Act and other laws in order to combat the prevalence of online abuse. Under §33.07 of the Texas Penal Code, an individual can be charged for online harassment when they use the name or persona of another person to create a web page on or to post one or more messages on a commercial social networking site under the following conditions:

  • Without obtaining consent
  • With the intent to harm, defraud, intimidate, or threaten any person

While Facebook is a common example of where these crimes can take place, laws also apply to all social networking sites, as well as to email, instant messaging, and other similar forms of electronic communication. According to Texas Penal Code §42.07, it can also be considered harassment when a person uses electronic communications with the intent to harass, annoy, alarm, abuse, torment, or embarrass another.
