Statutory Rape

Texas Sexual Abuse Attorney

In the state of Texas, any adult who engages in a sexual act with a child younger than the age of 17 commits a criminal offense. According to Texas Penal Code §22.011, sexual relations between an adult and a child under the age of 17 who is not a spouse can result in criminal charges for sexual assault. Sometimes referred to as statutory rape, this situation primarily concerns the age of the parties, regardless of whether the sexual relationship was consensual or not.

Age of Consent
Age of consent is a phrase used to define the minimum age at which an individual can legally consent to sexual acts. In Texas, this age is considered to be 17 years old. Texas does make legal exceptions, however, including marriage and age differences of less than three years. Laws involving sexual relations with a minor under the age of 14, however, allow for no legal exceptions.

Having represented numerous clients in statutory rape cases, it is often the case that people in positions of power exercise their influence over children to gain consent. Victims must understand that adults are aware of the age of consent and of the inappropriate nature of their actions. This means that they knew they were committing an illegal act and must therefore be held liable for their actions.
