Sexting is the act of sending sexually explicit messages, photographs, or videos via text messages, cell phones, or other similar electronic communication devices. In the time that the American public has taken to realize the serious and adverse consequences of sexting, the practice had already become incredibly widespread. Throughout the country, a number of individuals have become victims of numerous forms of sexual abuse as a direct result of sexting. A large percentage of sexting also occurs in schools and involves minors.

Cyber Sex Crimes

In an effort to address the negative repercussions that sexting can impose on victims, several states have passed legislation that directly prohibits sexting as a type of cyber sex crime. However, many states have also reduced the severity of criminal penalties for juvenile offenders. In Texas, Senate Bill 407 was passed to address the issue of sexting and the distribution of explicit images of minors. Under the new law, minors that intentionally and knowingly promote or possess text messages that involve child pornography will be prosecuted for misdemeanor offenses rather than felonies.

While this new law may be a point of dispute when it comes to handling offenders, it fails to address the effects that sexting can have on victims. Often, sexting is used as a form of sexual bullying, sexual harassment, and outright abuse. As a result, victims can experience extensive amounts of emotional distress, trauma, humiliation, and other negative psychological effects.
